Terms of Service

Welcome to JavaMove. These Terms of Service ("Terms") constitute a legally binding agreement between JavaMove ("we", "us", or "our") and the moving company operator subscription entity ("Subscriber" or "you"). By creating an account or accessing the platform, you agree to these Terms.

1. License Grant and Gated Modules

Subject to prompt payment of plan fees, we grant you a limited, non-exclusive, non-transferable, revocable subscription license to access the JavaMove platform. Certain modules (including Whisper Call Transcribers, Route Optimizers, and Warehouse stack coordinators) require active premium feature flags. Attempting to bypass subscription validation checklocks or RLS tenant guards will trigger automatic account termination.

2. Subscriber Carrier Liability Disclaimer

JavaMove is a SaaS software provider. We do not operate trucks, execute customer packing/moves, file household goods tariffs, or carry motor carrier insurance. The Subscriber is solely responsible for compliance with all federal (FMCSA, DOT) and state carrier regulations, retaining signed Bills of Lading, maintaining active cargo/auto insurance, and resolving all end-customer damage claims.

3. Third-Party Integrations Disclaimer

The platform coordinates connections with several external service providers. We are not liable for:

  • Delays, routing failures, or transmission errors in SMS alerts and gateway communications.
  • Chargebacks, payout holds, or processing failures incurred via integrated payment gateways.
  • Authentication sync interruptions or feed discrepancies powered by financial API connectors or accounting software integrations.

4. Limitation of Liability

IN NO EVENT SHALL JAVAMOVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, REVENUE, OR OPERATIONAL DOWNTIME) ARISING FROM SYSTEM USE. OUR TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT IS STRICTLY LIMITED TO THE ACTUAL FEES PAID BY YOU TO JAVAMOVE IN THE TWELVE (12) MONTHS PRECEDING THE APPLICABLE CLAIM.

5. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflicts of law principles. Any dispute arising from these Terms shall be resolved exclusively through binding arbitration administered in Boston, MA.
